Life Rewards™ Program Rules, Terms, and Conditions

Acknowledgment and Acceptance
Aquatic Life Company requires that all participants in the LIFE REWARDS™ Reward Program (the "Program") comply with the following rules and regulations.  By participating in  the Program, you agree that you have read, understand, and agree to these rules, terms, and conditions, as they may be modified by Aquatic Life from time to time (the "Rules, Terms, and Conditions"), and that your use of this Web site and your participation in the Program is subject to these Rules, Terms, and Conditions.  If you do not agree to be bound by these Rules, Terms, and Conditions, please do not participate in the Program.  Aquatic Life reserves the right, at its sole discretion, with or without notice, to modify these Rules, Terms, and Conditions, and any of the rules, procedures, and conditions pertaining to the Program at any time.

Aquatic Life Privacy Policy
Aquatic Life is committed to maintaining the privacy of Eligible Participants (as defined herein) in the Program and the personal information of those Eligible Participants.  For more information, please see our Privacy Policy.

Eligible Participants
The Program is open only to residents of the United States of America ages 18 and older who reside in the fifty U.S. states and the District of Columbia.  Persons under the age of 18 or those who reside in countries other than the United States or those who reside in Puerto Rico or other U.S. territories, commonwealths or possessions are not eligible to participate in the Program.  All requests received from persons under the age of 18 or those who reside in countries other than the United States or those who reside in Puerto Rico or other U.S. territories, commonwealths or possessions, shall be void. 

Aquatic Life's site and the Program are not directed to or intended to be used by children under the age of 18.  Aquatic Life reserves the right at any time to limit LIFE REWARDS (as defined below) usage and participation in the Program. 

Employees of Aquatic Life, its affiliates, agents, marketing and promotional agencies, and the immediate families and those living in the same household of each are not eligible to participate in the Program.

LIFE REWADS
LIFE REWARDS points are available on "Aquatic Life" product packaging sold by Aquatic Life with a LIFE REWARDS coupon.  Eligible Participants must purchase Aquatic Life products that have the LIFE REWARDS coupon to obtain the points.  The point value for each specially marked Aquatic Life product will be clearly visible on the outside of the product packaging on the coupon.  Points are calculated based on the value stated on the coupon of the Aquatic Life product that is purchased and are allocated in increments of 10 points.  LIFE REWARDS Coupons have no cash value.  LIFE REWARDS points and coupons are not sold separately.

LIFE REWARDS Points
Eligible Participants who have purchased Aquatic Life product with LIFE REWARDS coupons may visit www.aquaticlife.com/rewards to view program details and a list of items they can obtain by redeeming points.  Items for redemption will not be anything generally sold to Aquatic Life customers.  Items will include things like tee shirts, posters and collectables.  Only original LIFE REWARDS coupons may be sent in to obtain a reward.  If the LIFE REWARDS coupon points sent in for redemption exceed the number of points required for redemption of the desired item or items, Aquatic Life will be unable to return any remaining points and they will be forfeited.  The act by any Eligible Participant of clipping and saving LIFE REWARDS coupons does NOT create any contractual obligation or relationship between the Eligible Participant and Aquatic Life. 

Aquatic Life reserves the right to void any coupons and points in the event the Eligible Participant has returned the merchandise from which such coupon and points originated.  In the event a redemption item is out of stock or discontinued, Aquatic Life reserves the right to either return the LIFE REWARDS coupons to the Eligible Participant or to substitute a similar item or multiple items of equal or better value for the requested redemption item.

Aquatic Life assumes no responsibility for computer system, hardware, software or program malfunctions or other errors, failures, delayed computer transactions or network connections that are human or technical in nature, or for damaged, lost, late, illegible or misdirected entries; technical, hardware, software, electronic or telephone failures of any kind; lost or unavailable network connections; fraudulent, incomplete, garbled or delayed computer transmissions whether caused by users, or by any of the equipment or programming associated with or utilized in the Program; or by any technical or human error that may occur in the processing of submissions or downloading, that may limit, delay or prevent an Eligible Participant's ability to participate in the Program.  Aquatic Life is also not responsible for typographical, photographic or other errors or omissions in either its rewards materials or its website. Aquatic Life reserves the right to reject redemption orders in the event of such an error. 

Aquatic Life is not responsible for lost or stolen LIFE REWARDS coupons and will not replace LIFE REWARDS coupons that have been lost or stolen. 

Transferability of LIFE REWARDS
LIFE REWARDS coupons may be transferred only to Eligible Participants as defined herein. 

Eligible Participant Obligations
Eligible Participants shall comply with all rules, laws, and regulations that are applicable.  Eligible Participants acknowledge that they may only participate in the Program if and to the extent such participation is permitted by such laws, rules, and regulations.  Aquatic Life may restrict, modify, or terminate an Eligible Participant's participation in the Program without liability to the Eligible Participant or any other party, if an Eligible Participant violates any law, rule, or regulation, or if an Eligible Participant's participation in the Program could violate any law, rule, or regulation.

Eligible Participants agree to provide only accurate and true information to Aquatic Life at all times and to comply with all the Rules, Terms, and Conditions governing the Program at all times.

Aquatic Life reserves the right to terminate at any time the participation of any Eligible Participant who violates these Rules, Terms, and Conditions or for any other reason, within Aquatic Life's sole discretion, and in accordance with applicable law.  All decisions made by Aquatic Life concerning the Program are final.

Termination of the Program
Subject to applicable law, Aquatic Life reserves the right to change, modify, or discontinue the Program at any time with or without notice.  Aquatic Life shall not be liable to any Eligible Participant, LIFE REWARDS transferee, or any other person should Aquatic Life exercise its right to modify or discontinue the Program. 

Disclaimer of Warranties
Eligible Participants expressly agree that participation in the Program is discretionary and at the Eligible Participant's sole risk.  Further, all goods or services offered in connection with the Program are provided on a strictly "as is" and "as available" basis without any legal warranties.  Aquatic Life shall not be liable or responsible for those guarantees, warranties and representations, if any, offered by Program manufacturers or suppliers of goods or services.  No advice or information, whether oral or written, obtained by an Eligible Participant from Aquatic Life through the Program shall create any warranty.

Limitation of Liability
AQUATIC LIFE SHALL NOT BE LIABLE FOR ANY DAMAGES, WHETHER DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL, RELATING TO THE PARTICIPATION OR INABILITY TO PARTICIPATE IN THE PROGRAM.  SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES; SO THE ABOVE LIMITATION OR EXCLUSION MIGHT NOT APPLY TO YOU.  Aquatic Life is not responsible for any damages or losses that result from participating or inability to participate in the Program, or reliance on or use of information, services, or merchandise provided on or through the Program.

Aquatic Life is not responsible and assumes no liability for any changes or discontinuances of service from providers that may affect offers or the accrual of points.  Subject to applicable law, Aquatic Life's liability to an Eligible Participant shall in no event exceed the amount of $50.  THE INFORMATION, PRODUCTS AND DESCRIPTIONS OF SERVICES PUBLISHED ON AQUATIC LIFE'S WEBSITE OR A LINKED SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS, AND AQUATIC LIFE SPECIFICALLY DISCLAIMS ANY LIABILITY FOR SUCH INACCURACIES OR ERRORS.  AQUATIC LIFE RESERVES THE RIGHT TO REJECT REDEMPTION ORDERS IN THE EVENT OF AN ERROR. AQUATIC LIFE DOES NOT WARRANT OR REPRESENT THAT THE CONTENT ON ITS SITE IS COMPLETE OR UP-TO-DATE. AQUATIC LIFE IS UNDER NO OBLIGATION TO UPDATE ANY CONTENT ON ITS SITE. AQUATIC LIFE MAY CHANGE THE CONTENT ON ITS SITE AT ANY TIME WITHOUT NOTICE.

Indemnification
To the maximum extent permitted under applicable law, Eligible Participants agree to indemnify and hold Aquatic Life, its affiliates, officers and employees harmless from any claim, demand, expense or damage, including reasonable attorneys' fees relating to participation in the Program or a violation of these Rules, Terms, and Conditions.

Governing Law, Jurisdiction
These Terms and Conditions shall be governed by the laws of the State of California, without regard to California or any other State's conflict of law principles. 

Intellectual Property Rights 
LIFE REWARDS, AQUATIC LIFE, as well as other names of Aquatic Life products, product features and services are trademarks and/or service marks of Aquatic Life in the United States. The Program is a proprietary program of Aquatic Life. Nothing contained herein shall be construed as conferring, by implication, estoppel, or any other legal theory, a license or right to any patent, trademark, copyright or other intellectual property right, except those expressly provided herein. The products, processes, software and other technology described at this site may be the subject of other intellectual property rights owned by Aquatic Life or by third parties and no licenses are granted herein. You may use the information contained on this site for informational purposes only. Commercial uses are prohibited. You may not change or modify the information in any way that may be adverse to the interests of Aquatic Life.
